NOVA Dance respects your privacy and is committed to protecting the personal information of children, parents/guardians, staff and other individuals who interact with us.

This Privacy Notice explains how NOVA Dance collects, uses, stores and protects personal information in accordance with the General Data Protection Regulation (GDPR) and applicable Irish data-protection law.

NOVA Dance is the organisation responsible for deciding how and why personal information is processed for the purposes described in this Privacy Notice.

 

What Personal Information We Collect

Depending on the services you use and your relationship with NOVA Dance, we may collect some or all of the following information.

Information about children

  • Child's name

  • Date of birth or age

  • Dance class and level

  • Attendance information

  • Information provided for performances, competitions or examinations

  • Emergency contact information

  • Relevant information provided by a parent/guardian to help us safely manage the child's participation

  • Photographs and videos, where applicable

  • Information about consent or preferences regarding photography, video and publicity

Information about parents/guardians

  • Name

  • Relationship to the child

  • Email address

  • Telephone number

  • Address where required

  • Payment and enrolment information

  • Communication history with NOVA Dance

Payment information

Where applicable, we may collect information relating to class fees and payments.

We do not normally need to store your full debit or credit card details. Where payments are processed through a third-party payment provider, that provider may process payment information in accordance with its own privacy notice.

Website and online information

If you use our website or online booking/enrolment systems, we may collect information such as:

  • IP address

  • Device/browser information

  • Information submitted through online forms

  • Website usage information, where cookies or similar technologies are used

How We Use Personal Information

We use personal information for purposes including:

  • Processing class registrations and enrolments

  • Managing dance classes and attendance

  • Communicating with parents/guardians

  • Providing information about classes, timetables and changes

  • Managing performances, showcases, competitions and examinations

  • Processing payments and maintaining financial records

  • Responding to enquiries

  • Managing emergencies and safeguarding children's welfare

  • Maintaining appropriate records

  • Meeting legal and regulatory obligations

  • Managing insurance requirements

  • Organising events and activities

  • Improving our classes and services

  • Sending relevant information about NOVA Dance

  • Taking photographs and/or videos where appropriate consent or another lawful basis exists

  • Publishing photographs/videos where the necessary permission or other lawful basis exists

  • Promoting NOVA Dance where appropriate consent or another lawful basis exists

  • Protecting the safety, security and rights of children, families, staff and NOVA Dance

We will only use personal information for purposes that are lawful, fair and transparent.

Our Lawful Bases for Processing

Consent

For example, we may seek specific consent for:

  • Publication of photographs/videos on our website

  • Publication of photographs/videos on social media

  • Promotional or marketing use of photographs/videos

Where processing is based on consent, you can withdraw your consent at any time.

Contract

We may process information where it is necessary to provide the services you have requested, such as administering your child's dance classes and managing enrolment.

Legal obligation

We may process information where necessary to comply with a legal obligation, such as applicable accounting, tax, employment or other legal requirements.

Legitimate interests

In some circumstances, we may process personal information where it is necessary for our legitimate interests, provided those interests are not overridden by the individual's rights and interests.

Examples may include managing the administration and security of NOVA Dance and communicating with existing customers about services they use.

Where we rely on legitimate interests, we will consider the impact of the processing on individuals and take appropriate safeguards.

Children's Personal Information

NOVA Dance provides services to children and recognises that children's personal information requires particular care.

We generally communicate with and obtain information from a child's parent or legal guardian where appropriate.

We will only collect information that we reasonably need for the purposes described in this Privacy Notice.

We will not knowingly collect unnecessary personal information from children.

We will take reasonable steps to ensure that children and their parents/guardians understand how their information may be used.

We will also take a child's age, maturity and understanding into account where appropriate, particularly in relation to photographs, videos and publicity.

Photographs and Videos

Photographs and videos may be taken during dance classes, rehearsals, performances, showcases, exhibitions, workshops, competitions or other NOVA Dance activities.

Where photographs or videos can identify a child, they may constitute personal data.

NOVA Dance will only take and use photographs/videos in accordance with an appropriate lawful basis.

Where we rely on consent, we will obtain specific consent from a parent/legal guardian for the relevant purposes.

Photography/video consent may cover separate purposes, such as:

  • Taking photographs/videos

  • Internal use

  • Website publication

  • Social-media publication

  • Promotional and marketing material

  • Publicity for performances and events

Consent for one purpose does not automatically mean consent for all other purposes.

Where possible, we will avoid publishing unnecessary identifying information alongside children's photographs/videos.

We will not knowingly publish a child's full name, home address, telephone number or other unnecessary personal information alongside their image.

Parents/guardians can withdraw photography/video consent by contacting NOVA Dance.

Please note that once an image has been published online, it may potentially be copied, downloaded, screenshotted or redistributed by third parties. NOVA Dance cannot guarantee complete control over material once it has been made publicly available.

Social Media

NOVA Dance may operate social-media accounts, including platforms such as Instagram, Facebook or TikTok.

Where photographs/videos of children are published on our social-media accounts, we will do so only where we have an appropriate lawful basis and, where required, appropriate consent.

Social-media platforms are independent organisations and may process information in accordance with their own privacy policies and terms.

NOVA Dance does not control how those platforms process information once content has been published on them.

Who We Share Personal Information With

We will only share personal information where there is a lawful reason to do so.

Depending on the circumstances, information may be shared with:

  • Teachers and authorised NOVA Dance staff

  • Class or event administrators

  • Examination or competition organisations where necessary

  • Venue providers where necessary for the organisation of classes/events

  • Payment providers

  • IT, booking or software providers used to operate NOVA Dance

  • Professional advisers where necessary

  • Insurance providers where necessary

  • Government bodies, regulators or law-enforcement authorities where legally required

  • Emergency services where necessary to protect a person's safety

We do not sell children's personal information.

We will not provide children's photographs to third parties for their own marketing purposes without an appropriate lawful basis and, where required, consent.

Third-Party Service Providers

NOVA Dance may use third-party providers to help operate the business, such as:

  • Online booking/enrolment systems

  • Payment processors

  • Email providers

  • Cloud storage providers

  • Website providers

  • Accounting software

  • Communication platforms

  • Event or examination platforms

Where these providers process personal information on our behalf, we will take appropriate steps to ensure that suitable data-protection arrangements are in place.

International Transfers

Some service providers may process or store personal information outside Ireland or the European Economic Area (EEA).

Where personal information is transferred outside the EEA, NOVA Dance will take appropriate steps to ensure that the transfer is carried out in accordance with applicable data-protection law and that appropriate safeguards are in place.

How Long We Keep Personal Information

We will keep personal information only for as long as reasonably necessary for the purposes for which it was collected, unless we are required to retain it for longer by law.

Different types of information may therefore be kept for different periods.

For example:

  • Enrolment and class information may be retained while a child attends NOVA Dance and for an appropriate period afterwards.

  • Financial records will be retained for the period required by applicable legal and accounting requirements.

  • Photography and video content will be reviewed periodically and deleted when it is no longer reasonably required for the purpose for which it was collected, subject to any applicable legal requirements.

  • Consent records may be retained to demonstrate when and how consent was provided or withdrawn.

Our intended retention periods are reviewed periodically.

How We Protect Personal Information

NOVA Dance takes reasonable technical and organisational measures to protect personal information against:

  • Unauthorised access

  • Accidental loss

  • Destruction

  • Damage

  • Unauthorised disclosure

  • Unauthorised alteration

Access to personal information will be limited to people who reasonably need it for their role.

However, no method of storing or transmitting information is completely secure, and we cannot guarantee absolute security.

Withdrawing Consent

Where NOVA Dance relies on your consent to process personal information, you may withdraw that consent at any time.

For example, you may withdraw consent for your child's:

  • Photograph to be taken

  • Photograph/video to be published on the NOVA Dance website

  • Photograph/video to be published on social media

  • Photograph/video to be used for marketing

Withdrawal of consent will apply to future processing.

It does not make processing that occurred before the withdrawal unlawful.
